§ 362.57. Enforcement; penalties.

    Enforcement. The fire department, Alachua County Environmental Protection Department, and the office of codes enforcement within the growth management department are hereby empowered to enforce this article pursuant to the relevant provisions of state and local law. To the extent violations of this burn ban occur in any municipality, their fire department, code enforcement department or police department shall have the authority to enforce the provisions of this Article.

    (2)

    Penalties.

    (a)

    Any person violating any of the provisions of this article shall be liable for all damages caused by such violation, which damages shall be recoverable in any court of competent jurisdiction, as well as the costs associated with suppressing and extinguishing the fire. The liability for the costs of suppression may extend to the person, firm, or corporation causing, directing, or permitting the activity, as well as to the actual violator.

    (b)

    Violation of any provision of this article shall be subject to penalties as provided in Chapter 24, Alachua County Code or any other remedy available at law or equity.
